1. Overview
This website is operated by Valhalla Hall, Inc., which owns and operates Reptile Feeder Insects ("Reptile Feeder Insects," "we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of reptilefeederinsects.com (the "Site"), including purchases made through the Site and your use of any content, information, products, features, or services made available through it.
By visiting the Site, creating an account, placing an order, or otherwise using the Site, you agree to these Terms and to the policies incorporated into them by reference.
If you do not agree to these Terms, please do not use the Site or place an order.
2. Eligibility and Use of the Site
By using this Site or placing an order, you represent that you are legally capable of entering into a binding agreement or are using the Site with the permission and supervision of a parent or legal guardian where required by law.
You agree to provide current, complete, and accurate information when placing an order or creating an account.
You may not use the Site or our products for any unlawful purpose or in violation of applicable federal, state, or local law.
3. Products
Reptile Feeder Insects sells live feeder insects and may also sell non-live products, including lighting, habitat equipment, feeding accessories, care supplies, and related merchandise.
Product availability, quantities, sizes, specifications, packaging, and selection may change without notice.
We make reasonable efforts to display and describe our products accurately. However, photographs and other representations are illustrative, and differences in screens, lighting, photography, packaging, production, and natural variation may affect how a product appears.
Live Feeder Insects
Live feeder insects are living organisms and naturally vary in exact size, color, appearance, activity level, and other characteristics.
Commercial size categories represent ranges rather than a guarantee that every individual insect will be identical.
Natural variation within an advertised size or product category is not, by itself, a product defect.
Our current Live Arrival Guarantee and rules concerning live feeder insects are contained in our Live Arrival Guarantee & Returns Policy, which is incorporated into these Terms by reference.
4. Feeder Selection and Animal Care
Customers are responsible for selecting feeder insects and feeder sizes appropriate for the animals in their care.
Our Feeder Size Guide, Feeding Guides, Care & Storage Guides, articles, FAQs, product descriptions, and other educational materials are provided as general information. Individual animals and husbandry circumstances vary.
Nothing on this Site guarantees that a particular feeder insect, feeder size, feeding frequency, husbandry method, or product will be appropriate for every animal or circumstance.
Customers remain responsible for the care of their animals and for making appropriate feeding and husbandry decisions.
5. Orders
An order submitted through the Site is an offer to purchase the products identified in the order.
Receipt of an order confirmation does not necessarily mean that we have accepted or can fulfill the order.
We reserve the right, to the extent permitted by law, to refuse, limit, hold, or cancel an order when reasonably necessary, including because of:
- Product or inventory availability;
- Pricing, description, or listing errors;
- Suspected fraud or unauthorized payment activity;
- Shipping or address problems;
- Weather or carrier conditions affecting the safe shipment of live animals;
- Legal or regulatory concerns;
- Suspected misuse of our policies, promotions, or Live Arrival Guarantee;
- Unusually large quantities requiring different fulfillment arrangements; or
- Other circumstances that reasonably prevent us from fulfilling the order as represented.
If we cancel an order after payment has been collected and no portion of the order is being fulfilled, we will provide an appropriate refund for the canceled portion.
6. Pricing and Product Information
Prices are displayed in U.S. dollars unless otherwise stated.
We make reasonable efforts to keep prices, descriptions, quantities, availability, and other product information accurate. Errors may occasionally occur.
We reserve the right to correct errors or inaccuracies and, where permitted by law, to cancel an order affected by an obvious pricing, listing, inventory, or product-information error.
If payment has already been collected for an item we cannot provide because of such an error, we will refund the applicable amount.
Prices and product availability may change without notice before an order is placed.
7. Payment and Billing Information
By submitting payment information, you represent that you are authorized to use the payment method provided.
You agree to provide accurate billing, payment, contact, and shipping information and to update information when necessary to complete your transaction.
Payments may be processed by third-party payment providers. Your use of those services may also be subject to the provider's applicable terms and privacy practices.
We do not guarantee that every payment method will be available for every transaction.
8. Shipping and Delivery
Shipping, delivery, weather holds, receiving live feeders, address problems, missed deliveries, carrier delays, and related matters are governed by our Shipping Policy, which is incorporated into these Terms by reference.
Customers are responsible for providing a complete and accurate shipping address and for monitoring and retrieving live shipments as described in the Shipping Policy.
Because live insects are living animals, we may delay shipment when weather, holidays, carrier interruptions, or other circumstances create an unreasonable risk to the animals.
Carrier delivery dates and times are estimates unless expressly identified as guaranteed.
9. Live Arrival Guarantee
Our Live Arrival Guarantee & Returns Policy governs claims involving live feeder insects.
Live feeder insects cannot be physically returned or exchanged.
Submitting a claim does not automatically entitle a customer to a replacement, store credit, refund, or other remedy.
Claims are reviewed according to the requirements and conditions of the Live Arrival Guarantee. When a claim is approved, the appropriate resolution is determined as provided in that policy.
We reserve the right to investigate and deny claims that cannot reasonably be verified or that demonstrate a pattern of repeated or suspected misuse, as described in the Live Arrival Guarantee.
10. Returns, Refunds and Non-Live Merchandise
Returns, refunds, exchanges, damaged merchandise, defective merchandise, and incorrect merchandise are governed by our Live Arrival Guarantee & Returns Policy.
Live feeder insects and non-live merchandise are subject to different rules.
Live feeder insects are not considered damaged or defective non-live merchandise and must be handled through the Live Arrival Guarantee process.
11. Legal and Regulatory Responsibility
Customers are responsible for determining whether the purchase, possession, use, feeding, keeping, or disposal of a product is lawful in their location and circumstances.
We may restrict the sale or shipment of a product when required by law, regulation, permit conditions, carrier requirements, or other applicable restrictions.
The availability of a product on the Site does not constitute a representation that the product may lawfully be purchased, possessed, transported, used, bred, released, or otherwise handled in every jurisdiction or circumstance.
Live feeder insects must not be intentionally released into the environment.
12. Bulk, Institutional and Standing Orders
Bulk, institutional, breeder, rescue, school, retail, zoo, or standing orders may require different quantities, packaging, pricing, schedules, shipping arrangements, payment terms, or other conditions.
When separate terms are agreed to in writing for such an order, those written terms will control to the extent they differ from these general Terms.
13. Accounts
If the Site allows customer accounts, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You agree to notify us promptly if you reasonably believe your account has been accessed or used without authorization.
We may suspend or terminate accounts used for fraud, abuse, unlawful activity, repeated policy misuse, interference with the Site, or other material violations of these Terms.
14. Intellectual Property
Unless otherwise indicated, the Site and its original content—including text, photographs, graphics, illustrations, logos, branding, product photography, educational materials, guides, page designs, and other original materials—are owned by or licensed to Valhalla Hall, Inc. and are protected by applicable intellectual-property laws.
You may use the Site for personal, non-commercial shopping and informational purposes.
You may not reproduce, republish, distribute, sell, commercially exploit, scrape for republication, or create derivative commercial materials from our original Site content without our prior written permission, except as otherwise permitted by law.
Nothing in these Terms transfers ownership of our intellectual property to you.
15. Reviews, Photographs and Other Customer Content
If you voluntarily submit a review, photograph, testimonial, comment, suggestion, or other content to us or through a feature of the Site, you represent that you have the right to submit that content.
You may not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, malicious, or that violates another person's privacy or intellectual-property rights.
By submitting content for publication on or in connection with our business, you grant Valhalla Hall, Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with operating, promoting, and improving Reptile Feeder Insects, subject to applicable law.
We are not obligated to publish customer-submitted content and may remove content where permitted by law.
16. Prohibited Uses
You may not use the Site to:
- Commit or facilitate fraud or other unlawful activity;
- Submit false information or impersonate another person;
- Attempt to gain unauthorized access to the Site, accounts, systems, or networks;
- Introduce malware, malicious code, or other harmful technology;
- Interfere with the security or normal operation of the Site;
- Harvest personal information about other users;
- Infringe our rights or the rights of another person;
- Abuse promotions, discounts, refunds, chargebacks, returns, or the Live Arrival Guarantee;
- Use automated systems in a manner that materially disrupts or burdens the Site; or
- Circumvent restrictions intended to protect the Site, our customers, our business, or live animals.
We may restrict access to the Site or decline future transactions when reasonably necessary to address fraud, abuse, security threats, unlawful activity, or material violations of these Terms.
17. Third-Party Services and Links
The Site may rely on or contain links to services operated by third parties, including ecommerce platforms, payment processors, shipping carriers, mapping services, analytics providers, social networks, or other service providers.
Those third parties operate independently and may have their own terms and privacy policies.
We are not responsible for the content, availability, security, practices, or performance of independent third-party websites or services except to the extent responsibility cannot lawfully be excluded.
18. Website Availability
We work to keep the Site accurate, secure, and available, but we do not guarantee uninterrupted or error-free access.
The Site may occasionally be unavailable because of maintenance, technical problems, third-party outages, security issues, updates, or circumstances outside our reasonable control.
We may modify, suspend, or discontinue Site features where reasonably necessary.
19. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its informational content are provided on an "as available" basis.
We do not warrant that the Site will always be uninterrupted, error-free, or free from every harmful component.
Any warranties or guarantees applicable to products sold through the Site are limited to those expressly provided by us, the product manufacturer, or applicable law.
Nothing in these Terms excludes or limits any warranty, right, remedy, or protection that cannot lawfully be excluded or limited.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Valhalla Hall, Inc. and Reptile Feeder Insects will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or products purchased through it when such damages may lawfully be excluded.
To the fullest extent permitted by applicable law, our aggregate liability arising from a particular order will not exceed the amount paid to us for the product or order giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
Nothing in this section modifies any remedy expressly provided under our Live Arrival Guarantee & Returns Policy.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Valhalla Hall, Inc., Reptile Feeder Insects, and their officers, directors, employees, and agents from third-party claims, liabilities, damages, and reasonable costs arising directly from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person's rights.
This provision does not require you to indemnify us for our own negligence, misconduct, or other liability that cannot lawfully be shifted to you.
22. Privacy
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, products, Site, policies, legal requirements, or practices.
When we make changes, we will update the "Last updated" date at the top of these Terms.
Changes apply prospectively from their effective date unless applicable law requires otherwise.
Your order will generally be governed by the Terms and policies applicable when the order was placed.
24. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary without affecting the validity and enforceability of the remaining provisions.
25. No Waiver
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or any other provision later.
26. Entire Agreement
These Terms, together with the policies expressly incorporated by reference and any additional written terms applicable to a particular order, constitute the agreement between you and Valhalla Hall, Inc. concerning your use of the Site and purchases made through it.
If separately agreed written terms for a bulk, institutional, wholesale, or standing order conflict with these Terms, the specifically agreed written terms will govern that order to the extent of the conflict.
27. Governing Law
These Terms and transactions with Reptile Feeder Insects are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms deprives a consumer of rights or remedies that cannot lawfully be waived.
